Terms and Conditions

Before using our professional services, please review the key points of our terms and conditions in plain language:

  • Transparency: All costs are fixed in a cost estimate before any work begins.
  • Payment: Private clients pay upon collection; B2B clients have a payment term of 30 days.
  • Security: We provide a 6-month warranty on all craftsmanship and adjustments performed.
  • Responsibility: Instruments must be collected within 14 days after completion notice.

1. Subject Matter and Scope

These Terms and Conditions apply to all contracts between Basnetbase GmbH, represented by Lukas Fuchs, Burggasse 142, 1070 Wien, and its clients regarding the provision of services in instrument making, maintenance, and adjustment of musical instruments.

These terms are supplemented by the provisions of the Austrian Consumer Protection Act (KSchG) as well as the Distance and Off-Premises Contracts Act (FAGG), and comply with the general framework of the Datenschutz-Grundverordnung (DSGVO).

2. Booking and Appointments

Booking is conducted via a written request (email to [email protected]) or in person at the workshop. A contract is established once Basnetbase confirms the request and a date for instrument drop-off is fixed.

The initial diagnostic of the instrument is provided free of charge (0 €), provided this occurs during the first consultation.

3. Pricing, Taxes, and Payment

All prices listed on the website include the statutory VAT of 20%. Detailed rates can be found on our Services page.

Billing is based on the previously agreed cost estimate. Any changes to the calculation will be communicated to the client before execution and require the client's explicit consent.

Payment Terms:

  • Private clients shall make payment immediately upon handover of the instrument.
  • B2B clients (companies) have a payment period of 30 days from the date of invoice.

4. Deposits and Cancellations

For custom instrument build projects, a deposit of 30% of the estimated total value may be required. This deposit will be credited against the final invoice.

Appointments can be cancelled or rescheduled free of charge up to 48 hours before the agreed time. For shorter notice, Basnetbase GmbH reserves the right to charge a processing fee.

5. Execution and Acceptance

Work is performed professionally according to the standards of lutherie. Upon handover, the client receives a report of the work performed along with care recommendations.

Storage: The finished instrument must be collected within 14 days after notification of completion. After this period, a storage fee may be applied.

Rights to the finished instrument remain with the client; however, Basnetbase reserves the right to use photographs of the work for documentation purposes, unless the client objects (see Privacy Policy).

6. Warranty and Liability

We provide a warranty of 6 months on the work performed. This warranty refers exclusively to the craftsmanship of the service, not to the general condition or natural aging of the instrument.

Liability for damages resulting from unsafe storage of the instrument after delivery or improper handling by the client is excluded.

For further details regarding liability, please visit our Disclaimer.

7. CITES and Material Regulations

Basnetbase GmbH does not work with materials from protected species (e.g., ivory, Brazilian rosewood, tortoiseshell) without valid CITES documents. The presentation of such documents is mandatory for corresponding instruments.

For safety reasons, we decline work on electrical amplifiers that requires opening the power supply unit.

8. Final Provisions and Jurisdiction

Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected. The laws of the Republic of Austria apply.

The place of jurisdiction for all disputes arising from this contractual relationship is Wien.

Complaints can be addressed to the competent supervisory authority: Österreichische Datenschutzbehörde (DSB), Barichgasse 40-42, 1030 Wien, www.dsb.gv.at.
